Watching the Alex Jones "lawyers accidentally emailed his entire phone to the other side" drama unfold in real time was an utter and complete delight.

The joy from the knowledge that the fallout could be lasting for months/years to come is almost at the level of the Four Seasons Landscaping press conference.

From the news reports I am not sure his lawyers screwed up? The texts seem like something that should be produced, and once in open court ain’t no confidentiality, at least in my line.

You know this stuff better than I do, but might the screw up be in not contesting that some of the texts are privileged or the like? Yes, it does seem like the lawyer may have been complying with discovery despite his client, but maybe went a bit far in the disclosure?

I love the judge. Someone suggested she was not just doing great work as a judge, but also as a kindergarten teacher. And it is really true.

Should be able to claw back any privileged texts.

I can't imagine the guy talking to lawyers though. He just seems to do/say whatever without thinking.

I have to think in the data of his ENTIRE PHONE there are some communications that are not relevant to this litigation and/or privileged.

There were clearly privileged texts, which would be clawbackable in California, but I don't know about Texas. But the attorney said something about getting it 12 days ago, and 10 days having passed, so he could now use them, which suggests Jones' attorneys failed to ask for them back.

However, it also sounds like some of the texts were discoverable, such as the one about how much money Infowars made in a day, but Jones had refused to comply with discovery requests. That why he was given the ultimate discovery sanction, defaulted, and this is just a prove-up hearing.

I don't know, I suspect a lot of them can be used to show he is a liar. https://www.youtube.com/watch?v=WIZ3ySoMNYQ

I stand corrected.

To what end was he denying Sandy Hook? The media is trying to pump up reasons to take away guns?

It's TRCP 193.3(d)

Quote:

(d) Privilege not waived by production. A party who produces material or information without intending to waive a claim of privilege does not waive that claim under these rules or the Rules of Evidence if - within ten days or a shorter time ordered by the court, after the producing party actually discovers that such production was made - the producing party amends the response, identifying the material or information produced and stating the privilege asserted. If the producing party thus amends the response to assert a privilege, any party who has obtained the specific material or information must promptly return the specified material or information and any copies pending any ruling by the court denying the privilege.
