International Secondment
I'm not sure that's the right term, but, basically, a few of my clients have recently suggested that one or some of the mid-level associates in my department work in Europe for 3 - 6 months on a major transaction at one of their locations. Those who do it will still be associates of the firm, but will be at the client site for the entire time. This might differ from traditional secondment in that we would not be employees of the client and would still be working under the existing client agreement.
My firm does not have a hard and fast policy on this kind of arrangement, and negotiates each relationship individually, with input from the attorneys involved. My firm is suggesting that expenses would be handled like normal travel, i.e. all actual expenses would be reimbursed, but it sounds like the traditional exclusions would apply. That is, I couldn't charge to the client those costs that would be personal to me but higher at my location, like personal calls, dry cleaning, haircuts, etc. I guess that's fine, but I would think that they should at least give me a free (to me) international cell phone. And I'm sure that I could not get them to pay for recreational travel or EPL tickets. Anyway, what is the custom for handling this in Biglaw, or how have others heard of it being handled? How often can I reasonably expect to fly back to the States on the client's dime? Is it reasonable to assume that it should be far more often appropriate if I agree to fly economy instead of the customary (for international travel) business class? Is it reasonable to expect they pick up certain incidental expenses of mine, like costs of international mail forwarding and stuff like that? I suppose that I would save money as well, but the idea, for example, of having to deal with health care and similar issues in Europe sounds expensive to me. Also, can I reasonably expect to get credit for at least 8 hours per U.S. business day, even if the work isn't there? I assure you that this is not a "my practice is more exotic that yours." I think the whole thing is stupid, and it seems to me a collosal waste of money on the part of the client. |
