Then we get to say, "I'm not like them, so fuck off. I'm not thinking about this shit beyond whether or not I do intentionally evil racist shit."

From a quick skim, it is because Detroit Edison was not found to be sufficiently governmental to qualify for an exemption from the Sherman Act. In your hypo, the city would be sufficiently governmental. So bad hypo.
