CHICAGO - An appeals court said a man can press a claim for emotional distress after learning a former lover had used his sperm to have a baby. But he can't claim theft, the ruling said, because the sperm were hers to keep.

The ruling Wednesday by the Illinois Appellate Court sends Dr. Richard O. Phillips' distress case back to trial court.

Phillips accuses Dr. Sharon Irons of a "calculated, profound personal betrayal" after their affair six years ago, saying she secretly kept semen after they had oral sex, then used it to get pregnant.

He said he didn't find out about the child for nearly two years, when Irons filed a paternity lawsuit.

Someone tell me why, exactly, this guy was nominated for an Oscar. He was the worst part of Sideways. Great character, but he couldn't pull him off. A good actor would have stolen the movie from Giamatti with that role.

So, after the Knicks game last night*, I went to see Finding Neverland. Not a bad movie. But let me say this, Johnnie Depp can turn the biggest pile of cheese into something that makes sense. I guess if he can turn a theme-park ride into a hundred million dollar movie, he can make cheese watchable.

This is the main reason that I was irritated that Giamatti didn't get a nomination. It seems unfair to reward the lesser of the two actors.

I'm perplexed that the movie got so many nominations, but I didn't question his at all.

I think he looks for parts that let him redefine the movie with his acting. He likes to turn B movies into offbeat As. When was the last safe part he had? The last part that a young Paul Newman or Robert Redford would have taken.
