IP rights are a creature of statute, authorized by the constitution. Why should the rights regarding restrictions on sales be broader than for any other form of property?

we're talking past each other. if I have a patent you can't sell something that infringes. If I don't have a patent you don't infringe. if what you want to sell will infringe then you need some justification. "you bought it in Canada?" sorry that fails for the two reasons I list (besides the FTC etc.)
