I think you're arguing hypotheticals. DMV people usually don't do the job they're suppose to, let alone more.
I'm in line at a NoVa DMV; It's a trailer in a parking lot, and there is a long line. Right ahead of me is a guy on crutches with pretzeled legs, all twisted around. That is, he can't be faking a handicap. He's renewing his handicapped plates. First, why would he have to wait in some big line to get a plate so he won't have to walk far given his handicap?
Anyway he eventually gets to the clerk who looks at his papers, looks confused and asks him for the docter evaluation. looking at his legs I was ready to give an evaluation based solely on my JD, but she was looking for some seal or something.
He asks her if he doesn't just need that first time, not for renewel. she looks confused for a second, then makes a decision "No you need it every time!"
luckily the guy asks to talk to a supervisor who says no note is necessary for renewel. This bim was going to put this pretzeled guy out of line to go to a doc, get back in line,etc. just because she didn't want to ask a question.

So anyway, whether DMV people are asked to fill out a referral to FBI/INS form, or not probably isn't too important.
