The judge determines whether there will be prejudice to you, your opponent, or itself. If any one of the three would be prejudiced (read: imminent trial date), the judge might deny the motion. Some states might even provide for an in camera conference so the attorney can tell the judge whether it's a conflict of interest withdrawal, and exactly how long it's been since he was paid.
