I can imagine it first arose in the course of witness prep for a suppression hearing.
"Okay, that's when the suspect said you could search under the seat cushions, right?"
"Well, it's not so much what he said as his --- you know --- body language?"
"Why don't we go with 'He indicated I could search the vehicle'?"
"Um, yeah. He must have temporarily forgotten about those glassine bags of narcotics and cocaine when he indicated that to me."
