I am not familiar with the Detroit Edison case, but nothing stops the government from giving away public education for free even though it impacts private schools.

It is amazing that I can tell him (and I have) that even black people internalize our society's racism and exhibit it reflexively constantly about ourselves. I can talk about how I enjoy a certain level of privilege based on how fair my skin is relative to other black people (white women feel way more safe around me than my b-i-l, as just one example) and how I come to expect to be treated a certain way when I am among other blacks.
And yet, if you broach this subject with white people, for the most part, they only hear, "You're racist. You have no control over your racism. You're bad." And they fight that shit with everything they have or give all sorts of justifications or exemptions or stories about the tough lives they or their parents had instead of saying, "That's interesting. I do remember some things I've thought or done that fall into this category. How can I recognize this and figure out how to overcome it?"
The topic of race is so charged in this country that instead of approaching the faults we all have when it comes to race and trying to understand what they are, how those problems manifest themselves and how to fix them like we would, say, poor grammar habits, we prefer to create a category of people who are intentionally evil who are the only ones capable of racist behavior. Then we get to say, "I'm not like them, so fuck off. I'm not thinking about this shit beyond whether or not I do intentionally evil racist shit."

One of us is at a law firm, and one of us gets to be a client all day, and I think you are forgetting which is which. Maybe you are thinking of Adder? I think he likes to answer questions like this and does it for a living. I tend to do it when I am stuck in HR meetings.

From a quick skim, it is because Detroit Edison was not found to be sufficiently governmental to qualify for an exemption from the Sherman Act. In your hypo, the city would be sufficiently governmental. So bad hypo.
