the fact is if i visit SF I would consider visiting Chez Spanky (presuming the invite :cross: of course) but I would be really nervous about the wild animals and frankly the potential accusations from the unattended kids.

So no malpractice issues if I walk off deal because I demanded a 100% fee premium and client refused? What if doctor mid surgery decides he wants to be paid in cash prior to end of surgery when patient doesnt pay, he walks out of surgery? Professional?

you are a special case. I ran this by the Detroit lawyers that we both know. they feel your walking off would actually lower the chance of malpractice.

Missed that argument. I hope the test wasn't strictly economic. Whether a gent's middle or upper class is best determined by his performance and predelictions in the bedroom. Lower-middle class men are always far superior. Upper Middle class -- not so good.

What does that have to do with the state of education? Business is not the problem it is the Teacher's Union. You don't see the business lobby blocking testing, or reforms to make it easier to fire teachers.

Maybe the contract they wrote before they decided is not good enough? People can always want more money. The fact that these teachers can demand more of anything, when the system is just a wreck is pathetic.

If you don't test students, you engage in social promotion, and you can't fire incompetant teachers it doesn't take a rocket scientist to figure out what happens.
In the districts in and around the Bay Area they have started enforcing the exit exam from High School and the first time some districts only had about fifty percent passing rate. They asked for a waiver but did not get one. They also asked that the kids be able to through the ceremony. This was also denied. Now these same students and studying to try and pass the exam. This year the number that passed went up because they want to graduate. Do you have any doubt that the number that passes will increase every year for a few years, and because of that more students will leave the system with a better education?
The Teachers Unions fought the exit exam every step of the way. They are still trying to repeal it. Can you really argue that a High School exit exam is a bad thing. Can you really argue that it won't force kids to learn? What the point of graduating students if they can't read and write?

Your hypo is that client refuses to retain you at the rate you asked for and then -- no attorney-client relationship in his mind -- you just started to do the work anyway? If so, no malpractice. But if you agree to act as his attorney for the deal even though he hasn't agreed what to pay you, that's your problem.

No. But also not analogous to what teachers do when they work without a contract for a period, and then stop.

One of the best things about being in politics is the people you meet along the way. During my career there have been those that particularly stand out, at the top of the list is Jalene Forbis.
