Query: If someone dies in 2010, but the Obit doesn't get published in the NYTimes until 2011, what year does it count for?

I was listening to RadioDisney this morning, in order to stay in touch with my younger fans, and noticed that between songs and as background they play Too Short's "Blow the Whistle". I think that is good background muzak, which I may co-opt for my office.
