I'm not convinced that there weren't some violations of securities laws as well, but even making that assumption, I believe (though this isn't my specific area of expertise) that the insider trader laws have been expanded by some courts to cover information received through a source, other than the issuer, if the discloser had a duty to keep it safe and the person trading on the information new that duty had been breached.

Hang onto it long enough and it's cool again. Particularly if the political winds change (McGovern '72, Reagan '76). Some are never going to be cool, though (Dukakis '88, Lamar Alexander (any year)).

I'm not really sure what we're debating, other than the last couple of tidbits, but wouldn't how the information is required to be treated by the House (or Senate) be relevant to determining whether it was "public" or not for purposes of determining improper trading? I mean, if the Wall St. J. is on newstands at 4:00am, can't you start trading on information therein at that point, regardless of whether you might have had earlier access to it?

Precisely. I was thinking of the senators as tippees w/r/t non-public info from contractors about to benefit from appropriations bills. The tippees would have the fiduciary duty and the senators would receive non-public information with full knowledge, etc.
