I'm with TM on this one. I think it is easy enough to say the batter needs to be making a reasonable attempt to get to first or he is gone. Just like running too far outside the base path.
When I played first base I could tell the ump thought I pulled my foot by not hearing him say out and just standing there. Pretty easy to deal with.
