He's on year three at the University of Michigan for an MBA/MS in Environmental sciences. He went to Cornell for Architecture school back in the 90s, so he thought he was prepared for long, harsh winters, but this has been ridiculous.

My question is really more of a constitutional one. If a person has no reasonable expectation of privacy in x, so that the Fourth Amendment is not implicated if the police watch and photograph x, does a private citizen have a First Amendment right to also watch and photograph x? Does the private citizen's motivation really matter in that context?
I'm not really arguing a side on this -- though I guess that, just by asking the question, I am saying that my own non-Con-law-scholar gut feel is that there is a problem with these criminal statutes. On the other hand, courts often deal with such issues in a way that borders on "fuck it, it's a bad thing so we make it a crime." And these distinctions may well exist.
AG's response -- comparing a groping to a fireman's rescue, say -- isn't really apt because that doesn't implicate the constitutional issues.
All that said -- this is really too much thought about upskirt photos. I say we take this discussion to a NSFW Tumblr site where it belongs.

There's not real beach weather anywhere in the states now. But you could head to the Ritz in Naples, Florida (that's the best resort in Naples), or maybe somewhere on Marco Island or in the Keys, and maybe get a day or two in the high 70s or maybe, if you're lucky, north of 80.

It's been pretty awful. I was just outside (43 degrees!) with no coat on and I wasn't cold. I was so used to freezing my ass off that 43 is AMAZING.

Don't take your son to Naples. Naples is for old people. I say that as someone who goes to Naples at least once a year.
You could do the Fountainebleau in Miami Beach. I wasn't overly impressed with it when we stayed there sometimes in the 1980s, but you can pretend you're Bond in Goldfinger and I'm certain it's been redone since then. Also, it apparently houses a Scarpetta, so you can eat well.

That’s because there aren’t any. It’s not an intrusion into seclusion for a cop to look through a window from the public right-of-way, and it’s not a violation of privacy for a private person to look through your window from the same point, BUT you can’t use a camera for the purpose of viewing the body of or undergarments worn by a person with the intent to gratify the lust, passions, or sexual desires of the viewer AND to invade the privacy of the victim.
So a cop and a civilian have an equal right to secretly take photographs of a person inside their home EXCEPT to gratify their lust. No constitutional issue raised by that distinction as I see it.

Tell the good people of our 50th state that.
California has had the mildest winter probably since I moved here. Which seems like adding insult to injury when I hear about how the rest of the country has fared. It's supposed to be 75 both days at the beach this weekend, for example. But from Michigan, the Keys are your best bet. If you want more resorty than Key West, I went to a wedding at Hawk's Cay years ago (it was actually 10 days after Sept 11). I thought it was nice (without being super extravagant).
