Yes, Hank. When you dumb it down to this level, as you artfully do, you and I agree. Miranda might indeed result in the government getting less out of the defendant than that would result from classifying him as an enemy combatant. The fruits of Pennypacker Montessori are wide and varied indeed.

wouldn't it be better for the environment if all the people making "green" documentaries for Sundance channel just didn't develop their film? do you know how many bad chemicals are generated by film development?

I for one do not think Miranda, or the constitution more generally is a meaningful impediment to iterrogation, which is why law enforcement hasn't entirely stopped since the decision. Also, people who Are good at intergation seen to agree that it isn't really an issue.

Also, one should be wary of anyone who says they will do really good job if Bly you will look the other way while they do it.

Finally, this whole thong is pathetic. A nitcse gets on a plane with a shifty explosive and the rights only possible reactions are that we should either invade someone or toture someone. How abOit instead we just acknowledge that a terrorist is a criminal too? There is smething really weird (in a police state sort of way) about being critical of propmt prosecutorial action.

I dumbed it down for space fuck, for you I'll use really simple words:

does miranda do anythig to protect an accused from admitting anything? again, I assume you'll agree it does, because if not you advocate eliminating miranda.

if miranda does stop some admissions can you see why we might not want that to occur with the bomber guy?

I'm not asking if a reasonable person couldn't feel we should give the bomber miranda rights. the point as framed was there is no down side to giving the bomber miranda rights, and I don't see how one can say that w/o arguing miranda is meaningless.

You're right I'm too stupid to have a real discussion.

All I know ks that my Teddy bear company could make a fortune if it weren't for the damn safety regs that prevent me from stuffing my product with medical waste. People would pay me to take the waste and of course it wouldn't undermine my sales at all.

Put differently, do you really think it is worth becoming the kind of state that torture and locks up people with no recourse (whoops, too late) of the off chance that it may accidently save a few lives everyone once in awhile? What'd the point and what justification have you for valuing one person's life and liberty hifgher than another in a worold where there are no restrictions on government power?

Finally, is there any reason other than cynical political gain to think that this guy has anything to share under torture?

who said torture? the question was do we interrogate him with or w/o miranda rights. then you said it makes no difference. but torture was never part of it.

So you think the only implication of declaring him an enemy combatant is that he doesn't get a lawyer? And you think that is what makes bill crystal so concerned about treating this (obvious crime ) as a crime?

i was asking you whether you could agree there is a potential downside to throwing this man into the US criminal justice system. as to your fear, do you think obama will authorize torture too, because I'd love to see that report. Ty would owe me like 100 wins,
