I don't do litigation and had never been on jury duty before so this came as a surprise to me: juries are very scary things.

I hope never to have a jury decide my fate, not even in a civil matter.

AL playoffs- would be RS v. Yanks except they are same division- so the wild card bounces to LA? I fear the Yanks, but I fear Fenway more. The Tigers NEVER win there.

Yes. Funny to laugh at the pictures of Wal-Mart shoppers. Less funny to have them deciding whether the prosecution has established all of the elements of the crime you're charged with, or whether the plaintiff is entitled to recover punitive damages from you under the relevant statute.

Lots of civil litigation settles.

this point would be more interesting if the sox didn't have the second best record. So it's 1 vs 4 (NY v Det) and 2 v 3

In a patent case you end up with lots of analogies to try to make complicated concepts understandable. But as in any other litigation, it mostly depends on the story you have to tell. It's very scary for defendants in bet-the-company cases.

the best trial lawyer i ever met- he did this twice, that i saw:

a case is heading to trial, but there are settlement discussions- at some jam-up in the talks, he'll say to the business guy, "let's go for a walk." we walk around the city, and at some point he says, "we'll you and the other guy can reach some business agreement, and you have certainty- OR- we can hand your companies fortunes to the next 8 people we walk by. It is a sobering way to convey the risk.

You can be successful (as always), but no Final Four this year. I think Kansas and Kentucky will both be ridiculously good. That said, guard play reigns supreme in the NCAAs and according to that article (and it's suspect since UNC didn't even crack the top 20 with what many believe is the best recruiting class), you guys have the best backcourt.

And in Detroit it takes three hours to pass 8 people on the street, so the business guy was exhausted too. Cunning.

Is drinking part of the initiation?

I figured there would be some sort of ceremony, but assumed it would be some weird melange of a five-figure deposit, burning some lace curtains, forced internment for an evening with a bunch of humanities professors drinking brandy, and a set of mock negotiations with a Blue Shield claims adjuster.

Of course I'm comparing apples to oranges. Why compare apples to apples? (By the way, oranges are better than apples.) I chose these two yesterday because (i) I was bored and (ii) people tend to have strong feelings about how unattractive they are. I don't think Garner's features are that much softer than Swank's, though. I will cop to liking Swank's bigger lips and agree that she should have her teeth filed down. But I don't think Garner is that pretty. I think Swank beats her in both categories, especially the body (even when they were both at their best).

TM

Swank is like the Seinfeld episode where her attractiveness varied moment to moment.

It's larger than a sextillion dollars, or a 1 followed by 21 zeros. Chiscolm's request is equivalent 1 followed by 22 digits.

The sum also dwarfs the world's 2008 gross domestic product of $60 trillion, as estimated by the World Bank.

Is this more or less ridiculous than the terrorist wannabe who tried to blow up my old building in Dallas yesterday thinking that it actually housed Wells Fargo Bank as opposed to a branch and 2 floors of loan officers and ops people?

The question, however, has been raised as to whether the case, in which Judge Chin gave the guy a month to show cause why it should not be dismissed, will derail his nomination to the Second Circuit.

Maybe being in New York skews the perception with more models and actresses (and wannabes of both) per capita than in the rest of the country.

A guy I used to know (who lived in Washington then, and NY now), used to travel to Minneapolis and come back talking abou thow hot the women are. But I always thought it had to do with the slightly higher percentage of blonds.

This story is about a group of white people who went out assauting black people, announcing to their victoms that they were out to assault people, called the victims racial epithets during the assaults, and even announced that they intended to assassinate the president and his family. The Star Tribune described the assults as "racially-tinged." Tinged? Like, there might be a little bit of racial stuff on the outskirts? Or maybe it's possible that the assaults may be slightly colored (sts) by racial motives? The Star Tribune is barely even a newspaper.

My favorite part was where the reporter said the two male suspects were "apprehended by a police canine."

If the dog had to bite them, I hope the poor thing is tested for rabies.
