The decision that started this all in Massachusetts based its ruling on the state constitution, not the federal, and overturned marriage discrimination on a rational basis standard.

If not for the states here, we'd be waiting at least a generation for marriage equality.

I've come to like marriage equality. If the states give it to us faster than the feds, bless 'em.

Except for the 30 so that have banned it. But, if you too agree that it is a states rights issue, you also owe an apology to Rand and should agree that basically every piece of civil rights legislation is unconstitutional. This is a banner day for the 9th and 10th Amendment here on Lawtalkers.

I think people who have some bizarre attachment to government at state or national levels are living in the 19th century. There is no rational ideological basis to prefer decisions at one level or the other.

There probably never was, but at this point in the day, it is really beyond silly.

I like to win. If we win at the state level, that is good.

I know we're all lawyers here, and so is Obama, but there is something to have a President making a statement on what he thinks is right, as opposed to what he thinks the Constitution requires.
