As always, I wonder who is advising these people.

You can check for case citations in the complaint yourself here. I scrolled very quickly and didn't see any.

Before that scroll, I was at least holding out hope that they might make a commerce clause argument or something (although they make APA claims), but no, they're saying they are special and they should be specially allowed to buy only the product as they want it.

For course, scrolling to the end answers my first question: Jones Day.

Reading the complaint is what resulted in my question. They have two S.Ct. refs in there: an uncited (?!) quote to Watson v. Jones, a case where the court abstained from intervening in a property dispute where a church passed an anti-slavery resolution and then sought to expell those who rejected it from the church buildings owned by the denomination. The other reference is to the Court's holdings, uncited again, that people have a constitutional right to the care which N.D. seeks to deny them.

Really, what is the case law they plan on using? This seems like a press hit rather than a case - in other words, a case only Scalia could support.

It's a penumbra, formed by emanations from the Bill of Rights as reflected in the contract the school signed with NBC to televise their football games. The Touchdown Jesus, Father Hesburgh, Rick Meier's draft ranking, Pat O'Brien, and the Lucky Charms Elf are other examples.

So now that the One True Church is advocating unfettered freedom to practice one's religion, can the Episcopals start marrying gays and the Mormons start marrying often? I trust we can expect a boatload of Jesuit lawyers advocating these positions, now, right?

Which Obama (and GGG, and likely you but I don't recall) both advocated against in 2007-2009.

If I recall, I was on the fence in 2007-2009. I agreed with Obama that Afghanistan should have been the main focus of the "War on Terror" from the beginning, but I did not have a lot of hope that we could create a functioning modern nation by putting in more military effort.

Actually, I can't recall the timing exactly, but I've been for getting out for quite some time. Certainly immediately after getting bin Laden would have been a great time to declare victory and bug out.
