This judge kinda rocks, and the lawyer's a bit of an ass.

Agreed. He apparently said this about asking for time off only if it is a boy: “Look, the Jewish religion is sexist. It just is. But I didn’t make the rules!”

The only problem is, he's right. Judaism has spent the last 50-100 years trying to make it right, but that doesn't change the fact that there is a significant difference between what has been commanded for 3,000 years (e.g., bar mitzvah) and what has been allowed since 1922 (e.g. bat mitzvah). Credit to the Jewish thinkers that struggled mightily with the sexist elements of the tradition -- would that Christianity could poach their talent.

I have no opinion on the subject, but some of what he said in his letter seemed rather unnecessary. Obviously I know nothing about the guy, so maybe it was an attempt at humor, but out of context it sounds rather strange to tell the judge "nobody's gonna care if it's a girl, and in fact they will be disappointed."

Which, of course, which is why Judge Wood's response was so perfect.

of course it was unnecessary. atticus's book learning aside, it was rude to his daughter and potential granddaughter.

and by the way, when the tea-partiers speak about "education being bad," atticus's analysis should spring to your mind.

I have read more detailed and nuanced defenses of the father in other forums, of which I am sure you are familiar.

I'm pleased and proud to serve as a subject in the first real study of applied Tea Party policy.

Magistrate Appointment

In an unusually smart move, the U.S. District Court for Silicon Valley appointed a Biglaw IP lawyer as a magistrate judge:

Quote:

The United States District Court for the Northern District of California is pleased to announce the appointment of a new United States magistrate judge.

The court has appointed Paul Singh Grewal to the position of magistrate judge in the court’s San Jose division. Magistrate Judge Grewal will take the seat vacated upon the retirement of Magistrate Judge Patricia V. Trumbull.

Before beginning his judicial career, Magistrate Judge Grewal practiced civil intellectual property litigation for approximately ten years with the Day, Casebeer, Madrid & Batchelder firm and with Howrey LLP (the two firms merged in 2009). Magistrate Judge Grewal earned his undergraduate degree from the Massachusetts Institute of Technology in 1993 and his law degree from the University of Chicago in 1996. After law school, he served as a judicial clerk to District Judge Samuel H. Bell of the United States District Court for the Northern District of Ohio and for Circuit Judge Arthur J. Gajarsa of the United States Court of Appeals for the Federal Circuit.

The court welcomes Magistrate Judge Grewal to the federal bench and anticipates that his broad experience with and knowledge of federal law and practice, together with his strong foundation in intellectual property law, will enhance the court’s services in the San Jose division.

Any guesses as to what percentage of judges and magistrates spent time at BigLaw before taking the bench?

This is a pretty interesting case. It seems like it was decided well. Link to blog.

That's definitely not what I was thinking.

Who makes this stuff up?

Calif. Judge OK’d Seinfeld’s ‘Festivus’ as Legitimate Religion, Ordered Special Meals for Inmate

Locked up in a California jail, Malcolm Alarmo King wanted healthier meals. In an argument apparently made to a friendly court, he won a ruling from Superior Court Judge Derek Johnson that he should be fed double-portion kosher meals.

Battling to keep its food costs down, the sheriff's department argued that King himself admitted "healthism" was the so-called religion justifying this request. But Johnson wasn't daunted, calling a sidebar with King's lawyer, Fred Thiagarajah, and the county prosecutor and asking for suggestions about a religion he could cite in the kosher-meal order to nail the issue down once and for all, the Orange County Register reported.

“I said Festivus,” Thiagarajah tells the newspaper—and Festivus it was. The holiday (Festivus for the rest of us) was popularized by the writers of the Seinfeld television show, county counsel argued to no avail.

King, however, has now served out his sentence, so further argument over the issue may be mooted.
