I didn't read it, but here's a long office of legal counsel opinion on having someone else sign on the prez's behalf. A quick scan suggests it doesn't directly answer your question though.

it's starting to seem probable that I'll be nominated to the Supreme Court by President Obama, as I am pro-choice but otherwise have solid American beliefs, but, reading this decision, it is clear to me that I will have problems writing things like, "In X we held"... when X was decided in 1968 and today's "we" includes none of that "we". I may turn down the nomination, if it comes.

or, alternatively, I may only accept if Ty is given a seat too, so I have a dull foil to attack in my decisions. We will see how it plays out.
