Because you seem (amazingly) sincerely unable to get it:
1. There was no logic error. I never argued that no one would raise comity arguments based on the laws of islamic nations (note, the Volokh post I linked to made the jump to "sharia" but the bit of the opinion he quoted didn't. I didn't read the rest of the opinion, so I don't know for certain whether that is accurate).
2. People raise legal arguments of varying merit all the time. That's what judges are for. See the Massachusetts case.
3. I agree with you about why the Oklahoma law is/was poor policy. It's overbroad. It's poorly drafted. And the "harm" of the potential for deference to foreign law (whether "sharia" or otherwise) where American choice of law rules dictate is vanishingly small (assuming that was the goal of the law - the text was significantly more broad as pointed out in the Volokh post Less linked to earlier), if it exists at all.
