In HIPAA, protected health information remains protected health information, even if the patient authorizes disclosure.

Senator Barbara Boxer appearing on Fox News this afternoon was asked about the 'Gang of Seven' deal not to Filibuster nominees unless it is Extra-ordinary circumstances; declared that "with the right to privacy and Roe v Wade on the table this is an Extra-ordinary circumstance and the Filibuster is on the table".

We are going to war. Bring it on you hag!

Except that it was a nefarious plot . . . just not an illegal one.

I forget, are you in the "as long as it's legal, it's moral" camp with Penske?
In my book, "nefarious" is sending your unqualified, partisan lout of a husband on the taxpayers dime to drink "sweet tea" "poolside".

"Nefarious" is telling someone you are CIA during a "heavy makeout session" on a third date.

I don't know much, which is why she's an attractive alternative.

1) Female
2) Unlike Edith Jones, didn't write a vicious dissent in the attempt to reopen Roe v. Wade 30 years on.
3) Elevated by this President, so must have some friends in the right places.

Strong advocate of the federalist revolution

    Favors limitation of Congressional power

    Conservative jurist

Has a narrow view of plaintiff "standing" - making it harder for plaintiffs to seek a remedy from the courts

Has authored several opinions that show a lack of regard for jury awards for pain and suffering

Has been criticized by fellow jurists for substituting her own view for those of trial courts and juries

Longtime member of the The Federalist Society, a conservative legal group

Wrote an opinion arguing that parts of the Americans with Disabilities Act was unconstitutional as applied to state and local governments. Justice O'Connor's judgment on a similar case was the opposite. The case O'Connor and the Supreme Court ruled on was well known because the disabled plaintiff had to climb up the County Courthouse steps for a court appearance because there was no handicap access to the building. He refused to climb again, and was arrested for not appearing in court. O'Connor and a majority of the Supreme Court held that the disabled deserved equal access to the courts.Tenn. V Lane; "Jurors Side with Disabled in Lawsuit" - MSNBC

    Notable cases:

Re Monumental: she authored a dissent that would denied class certification for to a group of African Americans who wanted to sue 180 insurance companies for charging them more than white customers for the same insurance policies.

Brown v. Parker Drilling Offshore Oil Corp: she vacated a jury award for a man who had been injured working on an offshore rig. He injured his back in the incident, and because he had not told his employer prior to his hiring that he had been treated at an emergency room previously for a back injury, Clement felt that the company owed him nothing for injuries incurred on the job.

Volger v. Blackmore: wrote the majority opinion drastically reducing the award to the family of a mother and daughter who died in a car accident, in part, she asserted, because there was not enough evidence that the daughter had experienced pain and suffering before dying. ( A fellow Fifth Circuit Judge criticized her for violating the deference to jury verdicts rule).

Planned Parenthood of Houston v. Sanchez: upheld a Texas statute that restricted the distribution of federal family-planning money to any organization that performed abortions or participated in abortion-related activities.

Are you not reading my posts? It takes two to tango. But one party is driving things more than the other lately. Ask yourself, who gains from what has been happening in the last few years? Hint: It's not liberal Democrats.
BS.

I'd love to see how much money the Dems raked in over the last few days in response to the "Dear Voter...Rove should be arrested...signed John Kerry" letters that have been flooding in-boxes around the nation.

eta: I misread "years" for "days" in your initial post

Good. That would be utterly fantastic.

Because then we go nuclear, Luttig or someone comparable goes in as the next Justice, and Estrada, et al all get a new vote on the Appellate slots.

What with Abe Fortas having been filibustered, surely the GOP isn't going to pretend that filibustering a Supreme Court nominee is unprecedented, etc.

I'm going to try saying this for the third time, since you don't seem to have paid attention the first two times. Niger is a pit. It is one of the poorest countries in the world, and most of it is sand or dirt. The kind of pools you find there are not the kind of pools that you want to lounge next to. No one could confuse Niger with St. Bart.

Moreover, Plame didn't "send" Wilson anywhere.

On that filibuster:

Quote:

The Senate was launched on a full-blown filibuster, with one South Carolina senator consuming time by reading "long passages of James F. Byrnes's memoirs in a thick Southern accent," according to a newspaper account.

That four-day talkathon in September 1968...
Do the Dems have enough balls to pull a (what I would call a) TRUE filibuster and shut down all Senate business - or would they pull a filibuster lite, as usual?
