OK. What about the consumers' privacy rights not to be disturbed in their own homes, jackass? So the fucking annoying telemarketers have a right to set off a noisemaker in our homes even though we affirmatively tell them we don't want them to?

It's dumbass judges like this that make me not so upset that they are grossly underpaid...

Despite the fact that the ruling is INSANE, it has also been set up by the Supremes over the years. There has been an ongoing expansion of the first amendment protection for commercial speech. And you see where this craziness leads...

I say amend the Constitution and eliminate the First Amendment.

That particular judge is well-known for scheduling hearings on motions he does not like for early in the morning -- e.g., 6:00 a.m.

Hey, is this really such a big deal? Can't we just treat people who come to your door or call on the phone as people, give them the courtesy of a hello, I'm sorry, I'm not interested, and leave it at that? We don't have to pick up the phone, do we (though I admit it would be rude not to answer the door)?

(Edited to add, we all have our unpopular causes, don't we? If we don't want government telling us what we can and can't do in the bedroom, why should government tell us who we can or can't call on the telephone or drop by to see?)

I am informed and believe that the telephone number in Judge Nottingham's chambers is (303) 844-5018. But I personally would not call that number. I just think it follows logically from his decision that you have a First Amendment right to know what that number is and to use it, even if he does not want to be called.

No. I normally do not answer the door when I am home alone. shit happens. However, you do not have caller id on your door and so must drop whatever you're doing, physically walk to the door to see who it is. And when it's a guy selling alarms and you have an obvious alarm sticker on your door, that's annoying.
Especially when it's every day (when you move into a new neighborhood). Understanding that when you're at home, you're doing one of 2 things - relaxing, or household chores (cooking, cleaning, fixing) and what's worse, is when you do open the door these people will not leave in a timely manner. They are trained that no does not mean no.
That said, sometimes you can't always know if it's a neighbor. Some people live blocks away. A woman who I didn't know came to the door asking if I'd seen her daughter (4 years old) who had "disappeared." I don't mind this - or the cop who came with her picture later. But I do mind the neighbor who came to my door and wanted me to sign a freakin petition so that she could break the CC&R's to run a business out of her house.

You do that a few times a day when you're right in the middle of whatever you're doing and it irritates people. But what would you know - you're a sock and why do I always get sucked into talking to socks?

Jumping in in the the middle and not having read any of the discussion before this, but whether it was Congress or the FTC made the distinction is irrelevant. It is, at least in the opinion of one judge (which on the surface appears reasonable), still a content based restriction on speech.

My recollection of First Amendment law says that's a fairly big no no..

Because Congress couldn't exempt their own political calls without throwing a bone to charities?

(Edited to say) Adder has it just right. The charity is in there because the political is in there - it's cover - but any such choice of content renders it all UC. If it banned all, it might be a valid TP&M limit.

So, do you think they'll re-pass it without charity and politics?

I've never understood the rage this issue brings out in people. Personally, I just don't get that many calls (of course, I'm usually not home during marketing hours).

But "right to set off a noisemaker?" You know you can turn the ringer off, right? You also know that you can purchase a service to block restricted numbers too, right?

It all strikes me as 1) a lot of complaining about a few rather minor (in the grand scheme of things) inconveniences and 2) in line with suing over not being warned about hot coffee. What's next, outrage over commercials on the TV and radio?
