So trump just offered the wrong doc then?

do you think a complaint has to prove your case?

"Thinking" that is impossible. You may muse about that while drooling over your pudding cup in a home for imbeciles. You may even fantasize about it, if you're deluded and have absolutely no understanding of satire and media law. But sorry; you may not think that.

Cut it some slack. You're asking a lot from a GPS system. They aren't built for that kind of search.

Shouldn't Maher move to dismiss on the ground that Exhibit B is not an actual birth certificate but rather a certification of what is on file at the office of vital records?

Maher noted that in last week's monologue, insisting Trump produce the long certificate.

Do you think one has to raise a sustainable, actual claim?

This case will be dismissed before a single deposition is taken. And the lawyer who brought it - not Trump - should be made to pay the other side's costs. Trump's a whore. This is his shtik. Balber knows better. (That or he needs to be assessed for a determination of whether he has highly-functioning Asperger's [wouldn't be the first, or even 1000th, freak with an "Esquire" after his name suffering that undiagnosed condition]).

Yeah, let's go back to the good old days, where we discussed the latest news in associate salaries and debated over whether WSGR was cooler than O'Melveny. Woo-hoo.

Tough call for Maher --- move to dismiss the suit, or take (and videotape) Trump's deposition for the endless comedic value it will provide.

But, this is California. It's filed in state court, and in Los Angeles. What that means is that Maher can have it both ways. He'll file a demurrer (what we call a motion to dismiss out here, go figure). The hearing won't take place for about six months (budget cuts have wreaked havoc in the Cal state courts, and LA is particularly bad. I recently had to beg a clerk for a hearing within a month, on a motion that the statute said required a hearing within 5 days.)

Meanwhile, discovery marches on -- you don't have to wait for the pleadings to be set here.

Maher should hire a star trial lawyer who will rip Trump's balls off for seven hours of questioning, then feature the best clips on his show for months to come.

Should be fun. If anyone knows Maher, tell him I'm available.

Putting aside the question of whether any reasonable person could believe it was a serious offer that one could accept....

A birth certificate isn't really proof of who one's father is, just what people chose to put on the birth certificate.* And of course after Trump made such a BFD about Obama's electronic short form birth certificate not being acceptable to prove where he was born, him submitting it as "proof" makes the whole thing just that more ridiculous.
