I don't know that anyone thinks the funeral home business is interstate commerce, and even if they did, there's no reason to think that an individual mandate is necessary to make regulation of that market work.

as many people out of state people die on interstate highways as out of state buyers that buy ollie's barbeque sammies, so the funeral industry is certainly IC.
