I'm guilty of this. Not really as a threat, but more to show the other side that this could get expensive, and that my demand is probably going to be the same (and likely will go up) after we complete fact discovery (when you ask to mediate). So it's almost always going to be cheaper to settle now. That being said, if I say I'm going to file, I always do. It's never a bluff.

My colleagues who don’t know how to work out obligations (it’s significantly about judgment-proofing the owners) are now playing distressed debt counsel and sending out invoices for this work.

If they’re working for small to mid sized businesses, they might as well wipe their asses with those invoices.

In normal times I understand the threat. But telling me that at a time when courts are effectively closed and not hearing cases that if I don't do X by Friday you will file is... kind of silly. Sure, go ahead, file, run up your bill, and maybe, maybe, you'll get a hearing in late April or early May by which time I'll have mooted the whole thing and you'll look silly.

By coincidence, I sold some on the Monday things were started dropping (just freeing cash for home improvements that are not happening now). But I chickened out and sold less than I was thinking about.

Yeah that's pretty bush league of him. In my experience so far, most lawyers are actually acting like human beings as a result of all of this.

So saw an analysis of why Michigan has like 500% of the cases that Ohio has. Testing might be part of it- but otherwise one main difference.

The Governors of the two States acted pretty much lock step on shutting stuff down. But we had our primary election and a week or so later Ohio cancelled theirs. Making people vote to tell Bernie to stand the fuck down kills people. The day Ohio cancelled I know other states had theirs- like Illinois.

Last I heard Bernie is "considering" stopping his run- which means he is "considering" killing more people.

There are ways to vote without making people stand in lines. If all of this prompts more states to make it easy to vote by mail, that would be a good thing.

Part of me misses going to the polling place, seeing the volunteers, getting that sticker. But on the whole, vote by mail is a winner.

Bernie's quitting. He's got other important things to do, like short the market and then announce he's going to hold up the stimulus bill.
