Depends on how bad of a beating. If it was just a nasty old punch up with a broken nose, jaw or orbital socket, that's one thing -- you could probably get away with that with probation or CS and anger management. But if you beat him to a bloody pulp, that could be different.
Also, you could always take a shit in a glad bag and mail it to him "From one asshole to another." I have read that it is impossible to get DNA from a turd.
