I don't think that judges can decide to keep a proceeding, especially a criminal proceeding, secret. (And more and more they are realizing, especially in the federal courts, that they can't be so loose about letting parties in civil cases keep stuff secret.) There would have to be a statute mandating that the proceedings are kept secret.

A private prelim would be a good idea. If judges started throwing out leverage charges at that stage, however, prosecutors would bitch and whine to no end, as this would remove their ability to wildly overcharge and scare defendants into pleas.

Poor phrasing on my part. It decreases the chance dubious charges would be sustained. The defense could knock out bullshit charges or entirely bad cases early.

I don't really have a view about whether Mark Wahlberg is a good guy or deserves a pardon. I didn't know anything about what he did before I read that. But what Ambinder said didn't really help me come to an opinion. Does he think anyone should ever be pardoned? Does he think that someone who wasn't famous who did what Wahlberg did should be pardoned, but Wahlberg shouldn't because he's famous? I'm sorry, you think Wahlberg, as a factory worker, would be doing this? He, with the conviction, is a role model. One can fuck up young and still turn it around.

There are people I know who are not movie stars and who have fucked up young and turned their lives around. Do you think they can't get pardoned? If so, perhaps you're right, but Ambinder didn't make the case.

As a broke 20 year old I tried to steal a 12 pack of beer from a 7-11. The clerk tried to stop me but I pushed him away. I was never arrested, but if I had I wouldn't expect a pardon.

Why not? Do you think a pardon is only for cases where someone was wrongly convicted? I think it's for more than that.
