Cite, please. Brandenberg is still good law. The question has never been whether anti-sedition laws are legal or illegal. It's whether the law prohibits more than incitement to imminent lawless action. If yes, it's unconstitutional. If no, it's not unconstitutional, whether or not the prohibited speech was seditious.

Espionage is a speech act. The First Amendment protects speech acts. Anti-espionage laws are constitutional not because they don't implicate the First Amendment, but because national security is a compelling state interest that overrides individual private interests. It should not be news to anyone here that the Bill of Rights does not prohibit jack shit -- it merely creates areas of heightened judicial scrutiny. Once a government shows the requisite state interest, bingo, no violation. I was making the point that "make no law" doesn't mean "make no law except to regulate time/place/manner." It doesn't even mean "make no law against." All is really means is "make no law unless you really really have to, and ask your local federal judge for permission." That's Con Law in a nutshell.

I know some Japanese guys circa 1940 who would suggest that Skokie was not a big change from earlier jurisprudence.

Yes, this practice exists. I knew people who used a tube to pass an exhaled hit from one person to another. No idea if it works. It was too disgusting to try. And anyone that cheap shouldn't have any drugs, IMO.
