Artistic merit isn't the difference between porn and not-porn. It's the difference between protected speech and unprotected obscenity. Fortunately nearly all porn has some artistic merit. Depictions of people having sex is porn. It may be good stuff -- what MacKinnon would call "erotica" -- or it may be bad stuff (e.g. degradation fetish porn), but at the end of the day these are only other names for "like it" and "don't like it."
