Dahlia is taking a long to time to say that: (1) because Kennedy will uphold it; (2) so too will Roberts because he is concerned about how he will be viewed by history (same will go for gay marriage), and he will want to be on the winning side of a 6-3 majority (and probably write the opinion to control it scope).
